Terms of SERVICE

Legal Entity: Betanomics, a corporation (“Betanomics,” “we,” “us,” or “our”)

These Terms of Use (“Terms”) govern your access to and use of Betanomics’s websites, apps, community server(s), bots, data feeds, tools, content, and any related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

1.1 Age/Legal Capacity. You must be 18+ (or the legal gambling age in your jurisdiction, if higher) and legally permitted to view or discuss sports wagering.

1.2 Jurisdictional Restrictions. You may not use the Service where doing so is illegal or restricted. You are responsible for compliance with local laws.

1.3 Account Security. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

2. Purpose; No Advice; No Operator Services

2.1 Informational/Educational Use Only. The Service provides information, education, and analytics. Nothing on the Service constitutes financial, investment, or betting advice, a recommendation, or a guarantee of outcomes.

2.2 No Betting Transactions. Betanomics does not accept or place wagers, settle bets, or operate as a sportsbook, bookmaker, or gambling operator.

2.3 User Responsibility. You assume all risk for how you use information obtained through the Service, including any betting you undertake independently.

3. Subscriptions, Trials, Billing & Cancellations

3.1 Plans & Access. Certain features require a paid subscription. A subscription grants a limited, personal, revocable license to access subscribed features for the subscription term.

3.2 Trial/Intro Periods. If we offer a trial (e.g., a one‑week membership), we’ll disclose its terms at sign‑up. Unless stated otherwise, trials convert to a paid, automatically renewing subscription at the then‑current rate until canceled.

3.3 Automatic Renewal. Subscriptions renew automatically at the end of each term unless you cancel before renewal. We will disclose renewal intervals and how to cancel at sign‑up and in your account settings.

3.4 Price/Plan Changes. We may change pricing or features prospectively. We’ll notify you in advance; continued use after changes take effect constitutes acceptance.

3.5 Refunds. All fees are non‑refundable except where required by law.

3.6 Cancellation. You can cancel at any time via your account settings or by following the instructions provided at sign‑up; cancellation takes effect at the end of the current billing period.

Consumer note (informational): Certain jurisdictions (e.g., EEA/UK) may grant additional cancellation or cooling‑off rights for digital services. See Section 17.

4. Acceptable Use; Anti‑Sharing; No Scraping

4.1 Members‑Only Content. Picks, projections, models, tools, data, and analyses available through the Service are for your personal, non‑commercial use only. Do not share, repost, resell, redistribute, or publicly display Service content (including in other Discords, social media, or paid groups) without our prior written consent.

4.2 Confidentiality. Service content (including pick timing, market prices, unit sizing, and model outputs) is Betanomics Confidential Information and trade secrets. You will protect it with reasonable care and not disclose it to third parties.

4.3 No Bots/Scraping. You may not scrape, crawl, spider, harvest, or use automated means to access the Service or extract data; no screen‑scraping/bulk copying, and no training of AI/ML models on Service content without express written permission.

4.4 Security/Abuse. Do not interfere with the Service, bypass access controls, or probe for vulnerabilities. One user per account; account sharing is prohibited.

4.5 User Conduct. No unlawful, abusive, harassing, defamatory, discriminatory, obscene, or otherwise offensive conduct. No promotion of illegal betting.

5. Community & Discord

5.1 Third‑Party Platform. Our community channels (e.g., Discord) are provided via third‑party platforms. Their terms and policies apply in addition to these Terms.

5.2 Rules. You must comply with Betanomics’s Community Guidelines (as updated from time to time). Violations may result in content removal, suspension, or termination.

5.3 No Solicitation. No advertising, affiliate links, selling picks, or DMs pitching services without our prior written approval.

6. User‑Generated Content (“UGC”)

6.1 License to Betanomics. If you post or submit content, you grant Betanomics a worldwide, non‑exclusive, royalty‑free, sublicensable license to host, store, reproduce, display, perform, adapt, and create derivative works from your UGC solely to operate, improve, and moderate the Service.

6.2 Your Representations. You represent you own or have the rights to your UGC and that it does not infringe third‑party rights or violate laws or these Terms.

6.3 Monitoring. We may monitor, filter, refuse, or remove UGC at our discretion, but we do not undertake to do so.

7. Intellectual Property; Limited License

7.1 Ownership. Betanomics and its licensors own all rights in the Service and Service Materials (content, data, models, software, and branding).

7.2 License to You. Subject to these Terms, Betanomics grants you a limited, revocable, non‑transferable, non‑sublicensable license to access and use the Service Materials for personal, non‑commercial use during your active subscription or authorized access period.

7.3 Restrictions. Except as expressly permitted, you will not copy, modify, translate, create derivative works from, reverse engineer, decompile, disassemble, or otherwise exploit the Service or Service Materials.

7.4 Injunctive Relief. Unauthorised use, copying, or disclosure may cause irreparable harm. Betanomics may seek injunctive relief in addition to other remedies.

8. Third‑Party Content, Data, and Links

8.1 Sources & Markets. The Service may display odds/market data, injury reports, or other third‑party content. Betanomics does not guarantee accuracy, timeliness, completeness, availability, or continued access to any third‑party data.

8.2 Links. Links to third‑party sites are provided for convenience and do not imply endorsement. Your use of third‑party services is at your own risk and subject to their terms.

9. Accuracy; Availability

9.1 No Guarantee. Analytics and projections are inherently uncertain; lines move and markets change. We do not warrant the accuracy, completeness, or reliability of any content or that the Service will be uninterrupted or error‑free.

9.2 Changes/Suspension. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

10. Responsible Gambling

10.1 Entertainment Only. Treat betting as entertainment, not a source of income.

10.2 Get Help. If gambling becomes a problem, seek help (e.g., National Council on Problem Gambling: ncpgambling.org/help‑treatment) or local resources.

11. Payments; Taxes; Chargebacks

11.1 Payment Processor. Payments are handled by third‑party processors; their terms apply.

11.2 Taxes. Prices may exclude taxes; you are responsible for any applicable taxes.

11.3 Chargebacks. We may suspend or terminate access for chargebacks, suspected fraud, or payment disputes.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL SERVICE MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BETANOMICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETANOMICS, ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL BETANOMICS’S TOTAL LIABILITY EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID TO BETANOMICS FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions/limitations; in such cases, these limits apply to the fullest extent permitted.

14. Indemnification

You will defend, indemnify, and hold harmless Betanomics, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service; (b) your UGC; (c) your violation of these Terms; or (d) your violation of any law or rights of a third party.

15. Dispute Resolution; Arbitration; Class‑Action Waiver (U.S. Users)

15.1 Binding Arbitration. For users in the United States, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by [JAMS/AAA] under its [Streamlined/Consumer] Rules.

15.2 Class‑Action/Jury Waiver. You and Betanomics waive the right to a jury trial and to participate in a class, collective, or representative action.

15.3 Small Claims; IP Injunctions. Either party may bring qualifying claims in small‑claims court. Betanomics may seek injunctive relief for IP or security misuse in any competent court.

15.4 Seat/Fees. The seat of arbitration is New York, NY, and the language is English. The arbitrator may award individual relief only, consistent with these Terms.

16. Region‑Specific Terms (Consumers)

16.1 EEA/UK Consumers. If you are a consumer in the EEA/UK, you may have statutory rights (e.g., digital‑content conformity, cooling‑off). If you request immediate access to paid digital content, you may lose the 14‑day withdrawal right once delivery begins. Nothing in these Terms limits non‑waivable consumer rights. Disputes may be brought in the courts of your domicile, and local consumer protections apply.

16.2 Canada/Australia/Other. Mandatory local consumer rights remain unaffected to the extent they cannot be waived by contract.

17. Termination

We may suspend or terminate your access at any time for any or no reason, including suspected violations of these Terms, non‑payment, or suspected fraud. Upon termination, your license ends and you must stop using the Service and Service Materials. Sections intended to survive (including 4, 6–8, 10–20) will continue in effect.

18. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Changes are effective upon posting (or as otherwise stated). Your continued use after an update constitutes acceptance.

19. Miscellaneous

19.1 Governing Law. These Terms are governed by the laws of [Governing State/Country], without regard to conflict‑of‑laws principles, except as provided in Section 17 and subject to Section 16 for U.S. users.

19.2 Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control.

19.3 Assignment. You may not assign or transfer these Terms without our consent. We may assign freely.

19.4 Severability; Waiver. If any provision is unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force. A waiver of any term is not a further or continuing waiver.

19.5 Entire Agreement. These Terms, plus any referenced policies (e.g., Privacy Policy, Community Guidelines), are the entire agreement between you and Betanomics regarding the Service.

19.6 Notices; Electronic Communications. You consent to receive notices and communications electronically. We may provide notices by posting to the Service or emailing your account address.

• Respect First. No harassment, discrimination, or personal attacks.

• Educational Only. No financial/betting advice; no guarantees.

• No Solicitation. No ads, affiliate links, or selling picks without approval.

• Members‑Only Content. Do not share picks/analysis outside Betanomics.

• No Spam/NSFW/Illegal Activity. Use correct channels; follow laws.

• Privacy. Don’t post others’ private information.

• Moderation. Mods may remove content and suspend/ban for violations.
