These Terms of Use ("Terms") govern your access to and use of Betanomics, including our iOS application, websites, join flow, memberships, content, community features, events, tools, and related services (collectively, the "Service"). The Service is operated by Select Technologies, LLC ("Select Technologies," "we," "us," or "our"). In these Terms, "Betanomics" refers to the Service, product, and brand operated by Select Technologies, LLC. By accessing or using the Service, creating an account, purchasing a membership, or participating in the Betanomics community, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and Regional Use
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. You may use the Service only where doing so is lawful. You are responsible for understanding and complying with the laws, rules, and restrictions that apply to you.
Betanomics provides informational, educational, research, and community-oriented services relating to prediction markets, especially sports-related markets. Betanomics is not a sportsbook, bookmaker, exchange, broker, gambling operator, financial adviser, or investment adviser. We do not place bets or execute trades on your behalf.
2. Accounts, Authentication, and Security
Members currently authenticate primarily through Apple or Google sign-in. Staff or administrative users may use separate authentication flows. You must provide accurate information, keep your profile information reasonably current, and maintain the confidentiality of your account credentials and devices.
- Each account is personal to a single user. Account sharing, credential sharing, and access resale are prohibited.
- You may not impersonate another person, misrepresent your identity, or create accounts for fraudulent or abusive purposes.
- We may enforce device-session controls, require reauthentication, or suspend access if we detect security, fraud, or misuse concerns.
- You are responsible for activity that occurs through your account unless caused by our breach of these Terms or applicable law.
3. Memberships, Billing, Renewals, and Payment Terms
Certain features of the Service require a paid membership. Membership tiers, billing terms, and pricing are presented in the join flow or otherwise in the Service at the time of purchase. By purchasing a membership, you authorize recurring subscription charges through our payment processor, Stripe, until you cancel future renewal.
- Memberships renew automatically on the disclosed weekly or monthly billing cycle unless canceled before renewal.
- You may stop future renewal at any time, but cancellations take effect at the end of the current paid billing period unless required otherwise by law.
- All charges are non-refundable. We do not provide refunds, credits, or prorated refunds for unused time, partial periods, or renewals, except where required by law.
- We may change membership pricing, features, or tier structure on a prospective basis.
- Failed payments, chargebacks, payment disputes, or suspected fraud may result in suspension, cancellation, or termination of access.
Payment processing is handled by Stripe and is also subject to Stripe's own terms and privacy practices. We do not store full payment card information on our own systems.
4. Acceptable Use and Community Conduct
Betanomics is a paid community and research platform. You agree to use the Service respectfully, lawfully, and in a way that does not undermine the experience of other members or the integrity of the platform.
- No harassment, abuse, threats, hate speech, discrimination, or targeted intimidation.
- No spam, scams, deception, impersonation, coordinated disruption, or other manipulative behavior.
- No posting or transmitting unlawful, infringing, defamatory, obscene, sexually explicit, or otherwise prohibited content.
- No promotion of illegal betting activity or use of the Service in a way that violates applicable law.
- No scraping, crawling, automated extraction, bulk copying, reverse engineering, or unauthorized monitoring of the Service.
- No reposting, forwarding, selling, relicensing, sublicensing, or redistributing member-only content outside Betanomics.
- No use of Betanomics content, reports, community discussions, or materials to train machine-learning or AI models without our prior written consent.
- No attempts to bypass access controls, moderation systems, suspensions, device restrictions, or account limits.
- No sharing of another person's private, confidential, or personally identifying information without permission.
- No commercial solicitation, advertising, or selling picks, services, or products through the community unless we expressly approve it.
5. Community Content, Moderation, and Enforcement
The Service includes member-generated and staff-generated community features such as channels, messages, reactions, polls, social features, follows, events, and uploads. We may review, screen, filter, block, remove, restrict, or report content or conduct at our discretion in order to operate the Service, enforce these Terms, protect members, and comply with law.
Moderation may include manual review and automated review. For example, uploaded media and certain content may be evaluated for policy, safety, or abuse concerns, including text moderation, image moderation, and OCR-based review. We may also log security-related events, including screenshot capture events on supported surfaces.
We may warn, temporarily suspend, restrict specific product surfaces, kick, remove, or permanently terminate any account for violations of these Terms, safety concerns, payment issues, security issues, suspected fraud, underage use, or other behavior we reasonably believe puts the Service or community at risk.
6. User Content and License to Operate the Service
As between you and Betanomics, you retain any rights you may have in content you submit to the Service. However, by posting, uploading, sending, reacting to, or otherwise submitting content through the Service, you grant Select Technologies a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, moderate, process, adapt, and use that content as reasonably necessary to operate, secure, improve, support, and enforce the Service.
You represent that you have the rights needed to submit your content and that your content does not violate law, third-party rights, or these Terms. We are not obligated to publish or keep any content available.
7. Betanomics Content, Intellectual Property, and Member-Only Materials
The Service, including our software, design, branding, research reports, analyst commentary, blogs, community structures, models, data presentation, tools, text, graphics, and other Service materials, is owned by Select Technologies or its licensors and is protected by intellectual property and other applicable laws.
Subject to these Terms and your active access rights, we grant you a limited, personal, revocable, non-transferable, non-sublicensable license to access and use the Service for your own non-commercial use. Except as expressly allowed by us in writing, you may not copy, publish, repost, distribute, broadcast, sell, license, create derivative works from, or commercially exploit Service materials.
8. Events and Community Participation
Betanomics may offer virtual or in-person events, event channels, and event-based community experiences. Eligibility, approval, attendance limits, event rules, venue rules, and participation requirements may vary by event and by membership tier. We may refuse, revoke, or limit access to any event at our discretion.
You are responsible for your own conduct, travel, safety, and compliance with event rules. We are not responsible for third-party venues, organizers, attendees, or circumstances outside our reasonable control.
9. No Advice, No Guarantees, and Assumption of Risk
Betanomics content is provided for informational, educational, research, and entertainment purposes. Nothing in the Service is financial advice, investment advice, betting advice, legal advice, or a guarantee of any outcome, return, price movement, or result.
Prediction markets and sports-related markets involve uncertainty, changing information, and significant risk. You are solely responsible for your own decisions and for evaluating whether any information is appropriate for your circumstances. Past performance, historical commentary, or prior results do not guarantee future outcomes.
10. Suspension, Account Deletion, and Termination
You may stop using the Service at any time. We may suspend, restrict, disable, or terminate your access, or place your account into a deleted-pending state, at any time if we believe it is reasonably necessary to protect the Service, the community, other users, our rights, or legal compliance.
If you delete your account, we may immediately cancel your active subscription and disable future access. If your account is terminated or deleted, your license to use the Service ends immediately, but provisions that by their nature should survive will survive, including provisions relating to intellectual property, payments already owed, disclaimers, limitations of liability, indemnity, dispute resolution, and enforcement.
11. Privacy
Your use of the Service is also subject to our Privacy Policy, available at /privacy-policy, which describes how we collect, use, disclose, and otherwise process information.
12. Third-Party Services and Links
The Service may interoperate with or rely on third-party providers such as Apple, Google, Firebase, Google Cloud, and Stripe. We may also include links to third-party sites or services for convenience. Those third parties have their own terms and privacy practices, and we are not responsible for third-party services or content except as required by law.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." SELECT TECHNOLOGIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR TIMELY.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELECT TECHNOLOGIES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to defend, indemnify, and hold harmless Select Technologies, Betanomics, and their affiliates, officers, directors, employees, contractors, and agents from and against claims, losses, liabilities, damages, judgments, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Service, your content, your violation of these Terms, or your violation of law or the rights of another person.
16. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Except where non-waivable law requires otherwise, any dispute arising out of or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in New York, New York, and you and Select Technologies consent to those courts' personal jurisdiction and venue.
17. Changes to the Service and These Terms
We may modify the Service and update these Terms from time to time. When we do, we will post the updated Terms on this page and change the last-updated date above. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
18. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce any provision is not a waiver. These Terms, together with the Privacy Policy and any additional rules expressly presented to you within the Service, form the entire agreement between you and Select Technologies regarding the Service.
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection laws.
